Activists Petition To Repeal Law Barring Uhuru From Politics

Two activists have filed a lawsuit in an attempt to overturn a statute that prohibits retired presidents from participating in active politics or holding leadership roles in political parties.

Section 6 of the Presidential Retirement Benefits Act, according to Peter Agoro and Damon Onyango, is discriminatory and hinders one’s fundamental ability to make political decisions.

The contested law clause states that “a retired President shall not hold office in any political party for more than six months after leaving office as President.”

The two want the court to overturn the provision of the Act that was approved in 2003, claiming that it violates the Constitution and is thus unlawful.

“Everyone is equal before the law and has the right to equal protection and equal benefit of the law, and the implicit or implied limitation under section 6 of the Presidential Retirement Benefits Act is in violation of the constitution and thus invalid,” the petition states.
