Absa Bank Slapped With A Ksh. 1.5Bn Fine

Mombasa Deputy Registrar Joshua Nyariki issued the order after Absa Bank failed to defend a case filed by New Mega Africa Ltd before the Commercial and Admiralty Court.

Mombasa High Court has ordered Absa Bank to pay a transport company Ksh1.5 billion for allegedly leaking confidential information to third parties.

Mombasa Deputy Registrar Joshua Nyariki issued the order after Absa Bank failed to defend a case filed by New Mega Africa Ltd before the Commercial and Admiralty Court.

“Having been duly served and failing to file a defense within the stipulated period of time, and upon application of the plaintiff’s advocate, I enter interlocutory judgment as prayed,” he said.

The interlocutory judgment was issued after the firm, represented by lawyer Titus Kirui, requested a final verdict in the suit on the grounds that the bank had failed to appear despite being served.

“New Mega Africa seeks judgment against the defendant, who has appeared but has failed to file its defense within the 14-day period despite being served with the summons.”

“The request is for an interlocutory judgment for Ksh1.5 billion, plus interest at court rates until full payment is made,” Kirui explained.
