DJ Brownskin To Spend One More Night In Police Cell

DJ Brownskin will have to spend an extra night in police cells after he lost his application today to have the DCIO Kasarani summoned in court for contempt.

Michael Macharia, also known as DJ Brownskin, who is facing allegations of aiding his wife’s suicide, had requested that DCIO Kasarani Jimmy Kimaru be summons to appear in court for breaching court orders.

In a ruling delivered today by Milimani Chief Magistrate Lucas Onyina, the court said that it cannot establish any offense of contempt since the court orders alleged to have been violated were issued by Makadara Law Courts which has equal jurisdiction.

“The accused person herein was arraigned before this court to take plea on allegations of aiding suicide. After the plea his advocate moved this court to issue summons against DCIO Kasarani citing breach of court directions. Counsel for the accused submitted that his client was coerced to confess to the offense as a condition for his release.

“The prosecution counsel told this court that matters raised by the defense arises from a miscellaneous file before Makadara Law Courts hence only Makadara stands the power to address the application. I do agree with the prosecution that indeed the file before this court does not have any contempt. I therefore direct the defense counsel to move Makadara Law Courts with the application to summon the DCIO if it deems fit,” ruled the Court.

Chief Magistrate Onyina also ordered the accused to remain in Custody until tomorrow when the court is expected to give a ruling on his release on bond.

Earlier on DJ Brownskin had also claimed, through his lawyer Duncan Okatch, that police were pressuring him to confess and acknowledge to the crimes as a condition for his release.
