Makallah Fred a social worker and Selina Awour who heads the new born delivery wing will have to take plea of various charges related to child trafficking as the prosecution alluded.
Judge Bernard Ochoi however discharged CEO Emma Mutio and Dr Regina Musimbi as the prosecution conceded to lack of evidence to press charges against the two.
Beatrice Njambi and Juliana Mbete were also discharged unconditionally as their lawyers assured the courts to corporate in case they will be required in future.
Mohammed was not present in court as he is hospitalized at Kenyatta hospital.
The three were to plead to charges against them before chief magistrate Martha Mutuku,.
The prosecution earlier revealed that out of the 77 files for abandoned children recorded only 49 cases can be traced.
The case came about after an expose by BBC showing the illegal business where Leparan was seen negotiating with undercover journalist
The suspects were arrested last week after police unearthed a child trafficking syndicate in Nairobi.
Lawyer Danston Omar thanked the court and the IO the speedy investigations but reserved on the damage of his client’s reputation.
”I will seek instructions from my clients to see how we can deal with the damaged reputation’’ Omar said.
“The courts have released the two distinct Covid heroes unconditionally and they are as clean as cotton, I urge the public to visit the facility without fear as the matter is now clear” he said.
