Linturi demands sex evidence held by DPP

Meru Senator Mithika Linturi has demanded that the DPP supplies him with documentary evidence that supports his alleged raping of a woman at a Nyanyuki hotel.


Linturi said frustrations by the prosecution have forced him to issue the request. Mithika had appeared before Milimani Chief Magistrate Susan Shitubi for mention of the same case. The court heard that he had not been supplied with the documentary evidence. Through his advocate, Linturi requested the prosecution to supply him with the statements recorded by the complainant and prosecution witnesses on January 30, 2021 at Maiyan Villas Hotel in Nanyuki.


He said that among the missing documents is an OB recorded on January 30 at Nanyuki police station and photographs of the accused taken by the complainant and the prosecution witnesses. He also requested the court to authorize the release of the Sh.200, 000 the state is holding which was recovered by the police.


The prosecution counsel opposed the release of the money arguing that professed money would be used as an exhibit in the matter. The state requested two weeks to send the documents to the defense and prepare for the pretrial hearing.


While addressing the media after the mention, Linturi cited that he is a law-abiding citizen and that’s why he appeared in court today. “I appeal to the DPP to supply me with all the documentary evidence supporting my alleged raping of a woman. I really would like to know the complainant in this matter,” said Linturi.


He also urged the prosecution to be ready on the mentioned date for the pretrial as he also wants to carry on with his campaigns. The pretrial has been set for November 30, 2021.
