KeNHA, Kilifi Magistrates Tighten Noose On Rogue Transporters

15 Coast-based Magistrates, 30 litigants, top Police officers, and Kenya National Highways Authority(KeNHA) Axle Load enforcement officers have held a series of meetings to explore legal ways of tackling overloading.

The seminars were held in Kilifi County, Mombasa County, and Kwale to discuss the East Africa Axle Load Control Act among other Axle load statutes.

The Kilifi meeting was facilitated by Chief Justice Florence Macharia and 25 staff members.

KeNHA Axle Load Assistant Director Michael Ngala said the meeting is part of compliance measures put in place by the KeNHA board to protect roads.

He said transporters will also be Sensitise as part of an all-inclusive approach to deal with the menace.

Ngala said courts play an important role in this compliance and urged the Magistrates to expeditiously deal with Axle load-related offenses.

He said swift application of the law by Magistrates will enhance compliance while aiding the facilitation of trade and finance.

“The Judiciary cuts both ways. But this knife is important for compliance enhancement”, Ngala said.

The workshop, facilitated by KeNHA was aimed at enlightening, educating, and sensitizing Shanzu Law Court officers on Axle Load Control Act.
The core of the meeting was to speed up the administration of justice on axle load-related offenses.

It brought together judicial staff, court users on how to speed up cases and end backlogs.

“KeNHA wants harmony in the enforcement of axle load. Self-compliance is the ultimate aim. But courts need to pen maximum penalties to make it hard for rogue transporters to overload.
