Laughter in Court as Elisha Ongoya Compares Gachagua Impeachment to Jesus Christ’s Trial

Lawyer Elisha Ongoya, representing former Deputy President Rigathi Gachagua, has criticised the impeachment proceedings before Parliament, arguing that they mirrored historical trials marked by predetermined outcomes.

Speaking at the Milimani Law Courts, Ongoya said he had reflected on several well-known cases in history which, in his view, were conducted without genuine regard for fairness.

“I have reflected on a number of unjust trials in human history. The trial of Sir Thomas Moore, Socrates and Jesus Christ,” Ongoya stated.

He argued that such trials shared a common feature where the outcome was effectively decided in advance.

“One element characterizes these trials: they are trials carried out with predetermined outcomes. Those taken through the trials are taken through the motions for the sake of it,” he said.

Ongoya further criticised the process undertaken against Gachagua at both the National Assembly and the Senate, describing it as procedurally compliant but substantively flawed.

“The motions that the first petitioner was taken through at the National Assembly and the Senate of Kenya passed the test of malicious compliance,” he added.

He maintained that while formal procedures may have been followed, the overall process raised serious concerns about fairness and the integrity of the proceedings.
