Salat Granted a Temporary Stay of Removal From KANU.

A tribunal in Nairobi temporarily halted the suspension of KANU Secretary General Nick Salat pending a hearing on the matter on Friday.

Salat had filed a lawsuit to prevent his expulsion from the party.

Desma Nungo, Chairperson of the Political Parties Disputes Tribunal (PPDT), stated that the notice of motion application was filed under Certificate of Urgency on January 19, 2023, for consideration ex-parte in this first instance only.

“That interim conservatory orders are hereby issued staying the implementation of the 2nd Respondent’s letter dated 15th December 2022 suspending the Applicant as the Secretary General of the Party given under my hand and seal of the Honourable Tribunal this 20th day of January 2023,” the stay orders state.

Nungo stated that the notice of motion application was filed under Certificate of Urgency on January 19, 2023, for consideration ex-parte in this first instance only.

As a result, the PPDT chairperson directed that responses be filed and served within five days.

The first respondent was the KANU National Executive Council, and the second was former Baringo Senator Gideon Moi.

The case will be heard in a Nairobi court on January 27, 2023, at 2:30 p.m., to confirm compliance and to issue further directions.

Ruto arrives in Kitale for Bishop Odonya’s consecration.

President Ruto arrived in Kitale on Saturday morning for a two-day tour of Trans Nzoia County.

Among those who accompanied him were Prime Cabinet Secretary Musalia Mudavadi, National Assembly Speaker Moses Wetangula, and Trans Nzoia Governor Natembeya.

The President is in Kiatali for Monsignor Henry Juma Odonya’s episcopal Ordination and Installation as Bishop of the Catholic Diocese of Kitale, which is currently taking place at the Kitale Showground.

Governor Natembeya has been holding meetings in the days leading up to Ruto’s visit.

The new bishop was a priest in Eldoret before being appointed by Pope Francis to lead Kitale Diocese on November 4, 2022.

He takes over for Bishop Maurice Crowley, who is retiring at the age of 75.

John Migun, the Dancing Kisumu Chief,  Lands a New Job

Mr. John Ogilo Migun, the Kisumu dancing chief, has been appointed to a new position in the government.

In addition to his role as an administrator, the 38-year-old Northern Sub Location assistant chief in Kisumu Central Sub-County has been chosen to market Huduma Kenya services.

Mr. Migun is seen in the video, which was shot at the entrance to Kisumu City’s Prosperity Building, educating the youth about the government services available at the Huduma Centre.

Mr. Migun, dressed in a Huduma Center-branded white shirt, is seen in the video urging the public to take advantage of the center’s extended hours in order to obtain the services they require.

“Sasa watu nguyaz, mabazuu na mayutman, services sasa ni saa moja asubuhi hadi saa moja jioni,” he says. Unatoka job, colle, ama works zako zingine unaingia Huduma centre, na baada ya hiyo saa majo unaenda kutulia, na baada ya hiyo saa majo unaenda kutulia, na ba (Greetings, my people and youth; services are now available here from 7 a.m. to 7 p.m. “You can leave your workplace, college, or other commitments and come directly to our Huduma centers, and then go chill,” Mr. Migun explained.

At the end of the video, he performs his signature dance moves with the other eight Huduma Centre employees.

Neither Mr. Migun nor Kisumu County Commissioner Josephine Ouko confirmed the new position to the Nation. They, on the other hand, stated that they were awaiting communication from the President’s Office.

Women Choose to Freeze Their Eggs to Avoid Pregnancy.

You’ve probably heard of the biological clock, whether you want to have children or not.

The one that rustles and tickles women’s ears wherever they go. Even if a woman isn’t thinking about it, someone else is and will inquire, “The clock is ticking, when are you having a child?”

Nonetheless, with the pressures of career, education, personal growth, and medical conditions, an increasing number of women are deferring pregnancy.

Some must wait until they find the right partner, while others must wait for career stability, and still, others must wait for the motherly instinct to kick in.

They know they will want to have a child at some point, and rather than leaving it all up to chance, some women are freezing their eggs.

Azimio Coalition, COTU Protest Ruto’s Tax Proposals

Raila Odinga’s Azimio La Umoja One Kenya Coalition and the workers’ union have protested President William Ruto’s administration’s decision to increase taxes, claiming that Kenyans are facing difficult economic times.

Opiyo Wandayi, Minority Leader of the National Assembly, has asked President Ruto to exempt Kenyans from heavy taxation.

“We feel the government needs to remove taxes on books and e-books, taxes on music on Spotify, and taxes on video streaming on Netflix. “These taxes target the most active and, at times, the most vulnerable segments of our population, which are performing artists and students in our colleges and universities,” the Ugunja MP said.

In a press release, Central Organization of Trade Unions (COTU) Secretary-General Francis Atwoli stated that the move to collect intelligence on people’s mobile money usage is ill-advised and will discourage many Kenyans from using mobile money platforms.

“Cotu would like to advise the government of President William Ruto not to hurt Kenyans in their mission to collect enough taxes to not only implement the promises in the Kenya Kwanza manifesto but also make Kenya economically independent of external debt.

“The move by the current government, as outlined in the 2023 Budget Policy Statement, to have access to and or investigate mobile money transactions, M-Pesa, is ill-advised and counterproductive. First, a majority of users of mobile banking are hustlers and the poor who overwhelmingly voted for this government. Second, this move will ultimately make Kenyans avoid using mobile money platforms and as a result, destroy a great innovation that has helped ease the movement of money, especially from the urban to rural areas,” he said.

Police Minister Set To Succeed Ardern As New Zealand PM

New Zealand Labour MP Chris Hipkins is set to replace Jacinda Ardern as prime minister after becoming the only nominee for the party’s leadership.

He was first elected to parliament in 2008 and was appointed minister for Covid-19 in November 2020. 

In Ms Ardern’s shock announcement on Thursday she said she did not have “enough in the tank” to lead.

The amount of time Mr Hipkins will spend in the role is uncertain as New Zealand goes to the polls in October.

He is currently the minister for police, education and public service.

KeNHA Sounds Warning Over Rampant Axle-Lift Abuse

Truck drivers plying the National and regional highways have been put on notice for illegally tampering with liftable axles.

According to KENHA, there has been an increase in trucks going into transit with their axles lifted.

“Our concern has been drawn to the rising cases of misuse of liftable axles within the National and Regional Trunk Road Network. This is from data that we have analysed from the various Static and Virtual Weighbridges located on the National Road Network.”

An axle-lift is often used by drivers to raise a set of wheels. This is often used to reduce road noise. However, drivers are tampering with the switches as it is only allowed when a truck is not in motion.

Engineer Kennedy Ndugire, a senior KeNHA engineer in charge of axle load enforcement, said the practice is a violation of the law.

“Drivers are tampering with the liftable axles system in blatant violation of the Axle Load Limit Laws. The net effect of lifting the liftable axle for a loaded truck is that its allowable gross weight reduces as fewer axles will be carrying the same load. For Example, a six (6) axle truck allowed by law to carry 50 Tonnes will be allowed to carry 42 Tonnes with the lift axle up since only five (5) axles will be touching the ground.”

The offence is spelt out on the East African Community Vehicle Load Control Act 2016, which provides for safe and lawful trucking within the 7 states.

“Liftable axles shall only be permitted on a vehicle if such axles are fitted with the manufacturer’s certified dead man’s switch or on air suspension system or with automatic dropdown when loaded”.

Tampering with the liftable axle system is an offence both under Traffic Act CAP 403 and the East African Community Vehicle Load Control Act ,2016.

The EAC Act under Section 20 (1) (i) states that: “a person commits an offence under this Act if that person operates a vehicle with a defective suspension, dead man’s switch other mechanisms in the vehicle that affects the weight of the vehicle”.

The EAC Act under Section 21. (1) states that: “a person convicted of an offence under section 20 by a national court shall be liable to a fine not exceeding fifteen thousand US dollars or to imprisonment for a term not exceeding three years, or both.”

Eng. Ndugire said the road authority will engage the Judiciary in ensuring such offenders face the full wrath of the law for damaging Kenya’s valuable road network.

“KeNHA continues to Sensitize transporters on effects of misusing the liftable axle. The Authority has also continuous engagements with the ODPP officers, Judicial Officers so that all of us play our parts in efforts to protect the very expensive road asset whose networth is over 3 Trillion Kenya Shillings.”

UK Prime Minister Fined For Not Wearing A Seatbelt

Prime Minister Rishi Sunak has been fined for not wearing a seatbelt in a moving car while filming a social media video. 

Lancashire Police said it had issued a 42-year-old man in London with a conditional offer of a fixed penalty.

Mr Sunak had previously apologised for the incident, saying it was an “error of judgement”. 

Passengers caught failing to wear a seat belt when one is available can be given an on-the-spot fine of £100. 

This can increase to £500 if the case goes to court.

The prime minister was in Lancashire when the video was filmed, during a trip across the north of England.

The video – to promote the government’s latest round of “levelling up” spending – was posted on Mr Sunak’s Instagram account.

It is the second time Mr Sunak has received a fixed penalty notice while in government. 

Last April, he was fined along with Boris Johnson and wife Carrie for breaking Covid lockdown rules – by attending a birthday gathering for the then-prime minister in Downing Street in June 2020. 

Fixed penalty notices are a sanction for breaking the law, and mean a fine, which needs to be paid within 28 days, or contested. 

If someone chooses to contest the fine, the police will then review the case and decide whether to withdraw the fine or take the matter to court.

Alleged Serial Fraudster Charged With Forgery

Suspect Josiah Nicholas Mbathi Mwangi is alleged to have forged an affidavit purporting it to be genuine and sworn by an Advocate of the High Court.

According to Court documents, on 13th August year 2018 at Nimba Technologies limited company offices within Nairobi County in the Republic of Kenya, Mwangi forged meeting minutes.

The suspect who was arrested by Detectives from Central Police Station Nairobi County was arraigned before Nairobi chief magistrate Susan Shitubi where he applied for plea taking to be deferred after he informed the court that he was unwell.

He however appeared before court on Friday 20th to answer the five counts of forgery, forging a company shares transfer deed form purporting it to be a genuine company shares transfer deed signed by the complainant.

Forging a company resignation letter dated 13th August 2018, purporting it to be a genuine Nimba Technologies limited company director resignation letter and forging an affidavit dated 13th August 2018, purporting it to be a genuine affidavit prepared, signed and stamped by Njugi B. Gachogu Advocate.

He denied particulars of the charges before Principal magistrate Bernard Ochoi and was released on a Bond of Kes 500,000 with an alternative cash bail of Kes 300,000.

The suspect is the Managing Director of Nimba Technologies and Mbawa holdings.
