Case Challenging Igathe Bid For Governor, Dropped

The Independent Electoral and Boundaries Commission (IEBC) has thrown out a complaint seeking to revoke the clearance of Nairobi County gubernatorial candidate Polycarp Igathe. 

In a judgement delivered by the electoral commission, the Dispute Resolution committee dismissed the complaint lodged by one George Bush saying it lacked merit. 

“The committee finds there is no evidence placed before it to fault the decision of the County Returning Officer (Caro) regarding the clearance of Igathe and the committee hereby upholds the COR’s decision with respect to the complaint in this matter. The committee holds and finds that the complaint lacks merit and hereby dismissed with no orders to cost, “ruled IEBC DRC chairperson Wambua Kilonzo.

In its ruling, the committee faulted Bush for failing to prove that Igathe has been found in any way to have abused or misused a public office or to have contravened chapter 6 of the constitution or had refused to execute the duties of his office and abdicated his office,” ruled the committee. 

The decision comes after Bush lodged a complaint seeking revocation of Igathe’s clearance and accused him of being unfit to hold public office after he resigned as the Deputy Governor of Mike Sonko without notice.

Bush wanted Igathe disqualified from the forthcoming elections on grounds of abdicating of official duties as the duly elected deputy Governor of Nairobi county in 2017-2022.

But Nairobi County Returning Officer (CRO) Albert Gogo discounted the allegations by Bush saying that there is no tangible evidence that Igathe abdicated his duties. 

Responding to the allegations that Bush was denied access to the Nairobi CRO’s office, Gogo said he could not bar Igathe from contesting on the strength of a letter which was not backed by any evidence.

Gogo said he received the letter for the resignation of Igathe as DG in question on June 8, a day after the conclusion of the clearance exercise.
