Doctor Files To Block KEMSA Surgery

A medical practitioner from Nakuru has filed a lawsuit to stop the Kenya Medical Supplies Agency from reorganizing.

Dr. Benjamin Gikenyi Magare, a specialist trauma and general surgeon at the Nakuru Level Five Hospital, has filed a case in Nairobi’s Employment and Labour Relations Court.

According to court documents seen by Uzalendo News, the petition wants an injunction to prevent the authority’s upcoming restructure and takeover by the National Youth Service.

In a press release issued on November 4, Kemsa announced general redundancies and ordered all non-core employees to take a 30-day mandatory leave to enable for the agency’s “restructuring.”

Dr. Gikenyi regrets that the restructure was carried out without sufficient engagement with stakeholders, rendering it illegal, radical, and unreasonable, and calling for it to be declared void.

Dr. Gikenyi wants the restructuring process to be halted and declared null and void by the court.

The doctor also wants the court to issue an injunction prohibiting NYS from becoming involved in the institution’s operation.
