Chitembwe Moves To Block Ouster Bid

Justice Said Juma Chitembwe filed a petition in court on Tuesday to prevent the Judicial Service Commission from removing him from office.

Justice Chitembwe, through his lawyers, submitted the motion as urgent, alleging that the JSC is conducting its processes in a manner that violates his constitutional rights.

He further contends that the petitions for his removal from office and the JSC proceedings under Article 168 (1) and (2) of the Constitution are based on his private communications obtained without his agreement and in breach of his constitutional right to privacy as guaranteed by Article 31 (d).

Justice Chitembwe has been at the centre of a maelstrom in the judiciary, with petitions filed questioning his integrity when former Nairobi Governor Mike Sonko shared viral videos on social media.

He has since minimized them, claiming that they were edited and distorted to smear his name.
