Kisumu: Two MCAs Risk Losing Seats For Missing 8 Consecutive Sittings

Two Kisumu County Assembly members face losing their seats after failing to attend more than eight consecutive plenary sessions.

Both Masogo Nyangoma MCA Habil Nyasuna and Nominated MCA Kennedy Ajwang have received letters from the Speaker of the County Assembly, Elisha Oraro, requesting that they provide an explanation as to why they shouldn’t be stripped of their positions in the legislature.

In the letter, the Speaker claimed that the two individuals had not provided official authorization for their absence from the Assembly, which is a requirement.

According to Section 194 (1) 6 of the Constitution of Kenya, the MCAs have until June 1 to provide an explanation as to why their positions shouldn’t be deemed empty. This provision can be found in Article 194.

In the letter that was dated May 24, 2023, the Speaker of the House of Representatives requests that the Members of the County Assembly (MCAs) provide sufficient justification for their absenteeism; otherwise, they could forfeit their respective positions.

Ordinary plenary sessions, which are held on Tuesday, Wednesday, and Thursday of each week in the Kisumu County Assembly, are where House legislation is conducted. These sessions are held every week.
